The Tenth Circuit Court of Appeals Affirms No Fault Verdict in Medical Malpractice Case

On May 21, the Tenth Circuit Court of Appeals affirmed the jury verdict finding of no fault on the part of a Hinkle Law Firm client.
The case involved claims that a doctor failed to diagnose a patient during an emergency room visit. The doctor had admitted the patient for observation and follow-up testing; unfortunately, the patient passed away while in the hospital.
Greg Young was the lead trial counsel for the doctor, and Peter Collins assisted. Defense counsel vigorously defended the doctor’s care.
Greg Young and Brian White prepared the written briefing on appeal. The jury returned a verdict in favor of the doctor, finding that he was not at fault for the death of the patient. The plaintiff appealed the verdict, which was then affirmed on appeal.
