Attorney to Prepare HOAs for New Legislation

J. Scott Pohl, a business and real estate attorney with Hinkle Elkouri Law Firm LLC, has teamed with Elsea and Petty HOA Management to bring a no-cost seminar homeowner’s association administrators, realtors and home developers.

The Kansas Uniform Common Interest Owners Bill of Rights Act was recently passed and becomes effective January 1, 2011.

“Homeowner’s associations now have a very short window in which to meet the requirements of the Act’s new regulations,” said Pohl. “We’re going to break down those regulations to give a clear and detailed picture on exactly what needs to be completed prior to the new year to remain in compliance with the law.”

A few of the topics that will be discussed include:

  • New duties required of the homeowners association
  • Liabilities of association board members
  • Restrictions placed on the board
  • Required bylaw provisions
  • Rules on meetings
  • Recordkeeping requirements

The seminar will be held twice: November 2, 2010 from 1:30 p.m. to 4:00 p.m. and November 4, 2010 from 6:30 p.m. to 9:00 p.m. Both sessions will be held at the Sedgwick County Extension Center, 7001 W. 21st St. North, Wichita, KS 67205-1759.
