Up until now, employers have (mostly) been able to exclude part-time employees from participating in their 401(k) plans. But the rules have changed. Under the SECURE Act, part-time employees who work 500 hours in three consecutive years – soon to be two consecutive years – must be given the opportunity to “defer” compensation in their employer’s 401(k) plan.

It sounds simple. But it’s not. Attorney Steven P. Smith will walk through these changes with you.

We will talk about the things you need to know to understand these new rules, including the following:

  • How do you count hours and when do you count them?
  • Can you still exclude employees who work more than 500 hours in three consecutive years?
  • Do you have to treat long-term part-time employees the same as other participants in your plan?
  • What happens if a LTPT employee later becomes a full-time employee?


This course will include a packet of materials, including a hard copy of the presentation. We have applied for SHRM, HRCI & CE accreditation.
