Hinkle Law Firm has a robust practice in which it represents an array of governmental entities (including states, municipalities, law enforcement organizations, and correctional facilities) that are being investigated on various civil rights issues by federal agencies (particularly the U.S. Department of Justice) and state regulatory bodies. Our attorneys’ extensive subject matter knowledge and deep experience working on these issues in both the public and private sectors has greatly served our clients’ interests and generally led to favorable resolutions of investigations.

Representations have covered a wide array of civil rights topics, including allegations of unconstitutional policing in violation of 42 U.S.C. 14141 and purported unconstitutional conditions of confinement for detainees, inmates, and developmentally disabled individuals in contravention of the Civil Rights for Institutionalized Persons Act. We work closely with some of the leading national law enforcement associations on these issues.

We also represent states and municipalities that are being investigated and/or sued for alleged voting rights irregularities arising under the federal Voting Rights Act, Help America Vote Act, National Voter Registration Act, and various state voting statutes. In addition, we counsel clients on compliance issues in these areas in an effort to stave off potential investigations and lawsuits.

Some of our greatest successes have never become public because victory was achieved by convincing investigators either not to pursue cases against our clients, or to significantly curtail the scope of mandated reforms/relief. When litigation is the best option, however, we have highly experienced trial counsel with proven records of success. Among the talented attorneys working on these issues are a former United States Attorney and Acting Assistant Attorney General at the U.S. Department of Justice, and a former Assistant Attorney General for the State of Kansas. Our experience has allowed us to adeptly handle extremely challenging and high profile issues in a way that has achieved excellent results for our clients.
